Geno Smith, who was cleared of DUI charges stemming from a January 2022 incident on Thursday, appeared to argue with police that he couldn’t fit into a cop car during his arrest, video showed.
Smith was arrested in January 2022 on suspicion of a DUI, and an apparent backlog rendered the Seattle Seahawks quarterback’s blood tests unavailable until this past April.
It was then revealed that Smith had a BAC of .038, below the legal limit of .08, and that he also had a THC concentration of 2.6, below the legal limit of 5.
He will not be charged with DUI or reckless driving in the case.
Video of the arrest, first reported by TMZ, showed Smith arguing with police over his height and the size of the cop car.
“I can’t fit in here. I don’t know what you want me to tell you, I’m [6 foot 4],” Smith said in the video. “If y’all can’t get a car that can fit me, I don’t know understand what y’all telling me.
“I don’t know how y’all fit people in here. Other Black males that look like myself at [6-foot-4] but I don’t know what you guys do, but I can’t fit back here.”
Smith, 32, who reached his first Pro Bowl last season after throwing a franchise record 4,282 passing yards, along with 30 touchdowns to 11 interceptions, was pulled over in January of 2022 when police accused him of driving erratically and switching lanes without signaling, police claimed, according to TMZ.
Smith was cleared of any wrongdoing.
“In considering the filing of charges, prosecutors must consider any reasonably foreseeable defense to be raised,” the King County Prosecuting Attorney’s Office said in a release.
“From the investigation material, prosecutors do not have evidence to rebut likely explanations for his bad driving. While we can show that Mr. Smith consumed alcohol and marijuana and that in general those two substances have a compounding effect, we do not have any evidence to show exactly what effect they had on Mr. Smith, and a reasonable doubt exists as to whether his ability to drive was affected by alcohol or marijuana.”
The Seahawks signal-caller signed a three-year extension with the club this past off-season, which will see him earn a base value of $75 million.
The former Jets quarterback will lead the Seahawks against the Rams in Week 1 on Sept. 10.
