Halle Berry claims her ex-husband Olivier Martinez is violating their co-parenting agreement by allegedly taking “the summer off” to galavant around Europe and Tinsel Town instead of completing their agreed-upon therapy sessions.
In legal documents obtained by The Post, Berry, 57, said Martinez, 58, “unilaterally decided to defer coparenting therapy altogether until September because he was traveling to France in the month of July and because his brother will be visiting him in the month of August in Los Angeles.”
The exes were married from 2013 to 2016 and locked in a nasty divorce battle until 2023. They share one child, a 10-year-old son, Maceo.
The “X-Men” actress and Martinez reached a new co-parenting agreement in May.
According to the court documents filed in Los Angeles last week, their “coparenting therapy was supposed to commence forthwith and the agreed-upon six conjoint sessions were to be completed by June 14, 2024. It is now July 26, 2024, and they have not even started.”
Berry alleged that “Olivier has effectively unilaterally decided to take ‘the summer off,’” noting that all co-parenting sessions occur on Zoom.
Berry claimed she’s “tried everything to foster a better coparenting relationship with Olivier” but “rather than support, she is met with resistance and conflict.”
She alleged her ex “has chosen to repeatedly violate agreements and court orders with careless disregard.”
“To him, the terms of the parties’ stipulated court orders are simply suggestions to follow when it benefits him and which he ignores when it does not fit his alienation agenda,” the documents read.
Berry noted that “none of this is good for the parties, and it is certainly not good for Maceo.”
“Olivier’s conduct harms the parties’ son,” she claimed in the filing, adding it also “causes further damage to the parties’ already strained relationship.”
The Emmy winner said, “If Olivier gets his way, nothing will begin until at least September because he unilaterally decided to take “the summer off.”
She wants a judge to force Martinez to stick to their schedule, which includes their co-parenting therapy and one-on-one sessions.
But Martinez hit back, denying her allegations. He claimed his famous ex filed her request when she “knew” he’d be traveling.
InTouch obtained his response, in which he claimed Berry “is constantly attempting to harass and strong-arm Respondent [Martinez] by forcing him into ‘submission’ using her wealth, and the legal professionals at her disposal.”
He is demanding the judge deny his ex’s request.
Berry and Martinez met on the set of the 2012 film “Dark Tide.” She revealed her pregnancy in April 2013, marrying the French actor in a private ceremony in France in July of that year.
After two years of marriage, the pair filed separate petitions for divorce in October 2015. At the time, they released a statement saying they acted “with love and respect for one another and the shared focus of what is best for our son.”
Berry and Martinez’s divorce war lasted eight years, and the exes finalized the end of their short-lived marriage in August 2023. They share joint custody of Maceo.
Berry agreed to pay her ex $8,000 in monthly child support and give him “4.3% of any income she receives above $2,000,000.” She also pays for Maceo’s fancy private school tuition, uniforms, school supplies, and all extracurricular activities.
